Criminal Law Study Guide Essay Murder carries a mandatory sentence of life imprisonment, which is 15 years. Sound memoryââ¬âthe person responsible must not be insane. Age of discretion ââ¬â a child less than 10 years old is not criminally responsible for his/her actions. Since S. 34 of the Crime and Disorder Act of 1998 the presumption of doli incapax has been abolished and consequently any child over 10 years has potentially full legal capacity. Unlawfully kills ââ¬â the act must be an unlawful killing. The law recognises that in certain circumstances the killing may be either justified or authorised eg. xecution or self defence. Living human being ââ¬â a foetus is not deemed in law to be a living human being. However, a murder conviction may be possible if a foetus is injured and, after birth, dies as a result of injuries sustained whilst in the womb. Attorney-Generalââ¬â¢s Reference (No 3, 1994) 1996. A defendant cannot be convicted of the murder of someone who is already dead at the time of the attack. R v Maicherek and Steel 1981 The accused had seriously wounded the victim who was then artificially maintained on a respirator. When it was discovered that irreversible brain damage had occurred the respirator was turned off M was found guilty of murder and his appeal was dismissed when he claimed the doctor had caused death. It was his act which caused death. The court appeared to favour the approach that death occurs when the victim is brain-dead. Queenââ¬â¢s Peace ââ¬â killing an enemy during wartime is not murder. Malice aforethought ââ¬â since the case of R v Moloney the mens rea of murder is the intention to kill or cause grievous bodily harm. ACTUS REUS The actus reus of murder is that the killing is unlawful, causation must be stablished (A caused Bââ¬â¢s death) and the victim must be a human being. (see causation notes from AS). MENS REA DIAGRAM MENS REA The mens rea of murder is malice aforethought which is the intention to kill or cause grievous bodily harm (GBH). There are two forms of intent: â⬠¢ Direct intent ââ¬â this is what D desires, eg. pointing a gun at someone and sh ooting them because you want to kill them. It was their aim or purpose to kill. â⬠¢ Indirect or oblique intent ââ¬â this is not necessarily what D desires but what he foresees will almost certainly happen, eg. D sets fire to a building and killed someone, did he foresee the risk that death might occur? Four important cases must be looked at. R v Moloney 1985 A soldier shot and killed his stepfather in response to a drunken challenge. He claimed that he had not aimed the gun at the victim and had, at the time, no idea that firing it would cause injury. The judge directed the jury that intention included both desire and foresight of probable consequences and the defendant was convicted of murder. Held (HL) Appeal allowed, manslaughter substituted. Lord Bridge did state that it was possible to intend a result which you do not actually want. He gave the example of a man who is trying to escape, who boards a plane to Manchester. Even though he may have no desire to go to Manchester ââ¬â he may even hate the place ââ¬â it is clearly where he intends to go. However, the appeal was allowed because foresight of consequences can only be evidence of intention ââ¬â it is up to the jury to decide. R v Hancock and Shankland 1986 Two striking miners pushed concrete from a bridge onto a road, killing a taxi driver. They claimed only to intend to block the road or frighten the taxi passenger and not to kill or cause GBH. They were convicted of murder but successfully appealed, a manslaughter conviction was substituted by the Court of Appeal and confirmed by the House of Lords. The House of Lords looked at risk and probability. A slight risk of death is not enough to infer intention: Lord Scarman stated the greater the probability that death or GBH would occur; the more likely that intention can be inferred, eg. if A cut Bââ¬â¢s little finger is would not be very probable that death would occur, therefore A is unlikely to have intention. However, if A stabbed B in the chest, it is much more likely that death would result, therefore it is more likely that A had intention. In both cases the defendants were convicted by the juries and appealed, first to the Court of Appeal and then to the House of Lords. In each case the House of Lords quashed the convictions for murder and substituted a verdict of manslaughter. The reason being the trial judges had misdirected the jury. The following case established the Virtual Certainty test which should always be used in indirect intention situations.. R v Nedrick 1986 The defendant set fire to a house, killing a child. He claimed that his intention was to frighten the childââ¬â¢s mother and not to kill or cause GBH. Convicted of murder. Held (CA) Appeal allowed, manslaughter substituted. Where direct intention is not present then the following test should be put to the jury. A jury should return a verdict of murder only where they find that the defendant foresaw death or serious injury as a virtual certain consequence of his or her voluntary actions. R v Woolin 1998 (HL) D shook his 3-month-old son when he choked on his food and then threw him across the room, the child died, D had lied to the ambulance men and the police before admitting what happened. He claimed that he did not want his son to die. He was originally convicted of murder but the House of Lords reduced his conviction to manslaughter. The trial judge had misdirected the jury on the test to infer intention. The case has now confirmed the Nedrick test. It must now always be used when dealing with indirect intent situations. R v Matthew and Alleyne 2003 (CA) The defendants appealed against their conviction for murder following the death of a young man (a non-swimmer) whom they had thrown from a bridge into a river. The Court of Appeal affirmed the conviction, which it did not consider unsafe in the light of the evidence, but expressed concern that the Nedrick/Woollin evidential rule should not be treated as if it were a rule of law. A defendantââ¬â¢s foresight of virtually certain death does not automatically require the jury to find that he intended that result: it is merely evidence from which the jury may draw that conclusion.

At present, some principal artificial intelligence techniques applied in antivirus detection are proposed, including heuristic technique, data mining, agent technique, artificial immune, and artificial neural network. It believes that it will improve the performance of antivirus detection systems, and promote the production of new artificial intelligence algorithm and the application in antivirus detection to integrate antivirus detection with artificial intelligence. Malware and its types Malware (malicious software) is software designed to infiltrate or damage a computer system without the owners informed consent. Malware types We can distinguish quite few malicious software types. It is important to be aware that nevertheless all of them have similar purpose, each one behave differently. Viruses Worms Wabbits Trojan horses Exploits/Backdoors Spyware Due to different behaviour, each malware group uses alternative ways of being undetected. This forces anti-virus software producers to develop numerous solutions and countermeasures for computer protection. This paper focuses on methods used especially for virus detection, not necessarily effective against other types of malicious software. Infection Strategies To better understand how viruses are detected and recognized, it is essential to divide them by their infection ways. A. Non Resident Viruses The simplest form of viruses which dont stay in memory, but infect founded executable file and search for another to replicate. Resident viruses More complex and efficient type of viruses which stay in memory and hide their presence from other processes. Kind of TSR apps. Fast infectors type which is designed to infect as many files as possible. Slow infectors using stealth and encryption techniques to stay undetected outlast. Methods Used A. Metaheuristic Metaheuristic is a heuristic method for solving a very general class of computational problems by combining user-given black-box procedures in a hopefully efficient way. Metaheuristics are generally applied to problems for which there is no satisfactory problem-specific algorithm or heuristic. B. Heuristic Heuristic is a method to help solve a problem, commonly an informal method. It is particularly used to rapidly come to a solution that is reasonably close to the best possible answer. General Heuristics It is important to remember that metaheuristics are only ideas to solve a problem not a specific way to do that. The most popular, and one of most efficient heuristic used by anti-virus software is technique called Heuristic Scanning. Specific detection methods like signature scanning became very efficient ways of detecting known threats. Finding specific signature in code allows scanner to recognize every virus which signature has been stored in built-in database. Heuristic scanning in its basic form is implementation of three metaheuristics: Pattern matching Automatic learning Environment emulation The basic idea of heuristic scanning is to examine assembly language instruction sequences(step-by-step) and qualify them by their potential harmfulness. If there are sequences behaving suspiciously, program can be qualified as a virus. The phenomenon of this method is that it actually detects threats that arent yet known! Fig1. Recognising Potential Threat In real anti-virus software, heuristic scanning is implemented to recognize threats by following built-in rules, e.g. if program tries to format hard drive its behaviour is highly suspicious but it can be only simple disk utility. Singular suspicion is never a reason to trigger the alarm. But if the same program also tries to stay resident and contains routine tosearch for executables, it is highly probable that its a real virus. AV software very often classifies sequences by their behaviour granting them a flag. Every flag has its weight, if total values for one program exceeds a predefined threshold, scanner regards it as virus. Fig.2. Single-layer classifier with threshold Heuristics Flags Some scanners set a flag for each suspected ability which has been found in the file being analyzed. This makes it easier to explain to the user what has been found. TbScan for instance recognizes many suspected instruction sequences. Every suspected instruction sequence has a flag assigned to it. A. Flag Description: F = Suspicious file access. Might be able to infect a file. R = Relocator. Program code will be relocated in a suspicious way. A = Suspicious Memory Allocation. The program uses a non-standard way to search for, and/or allocate memory. N = Wrong name extension. Extension conflicts with program structure. S = Contains a routine to search for executable (.COM or .EXE) files. # = Found an instruction decryption routine. This is common for viruses but also for some protected software. E = Flexible Entry-point. The code seems to be designed to be linked on any location within an executable file. Common for viruses. L = The program traps the loading of software. Might be a virus that intercepts program load to infect the software. D = Disk write access. The program writes to disk without using DOS. M = Memory resident code. This program is designed to stay in memory. ! = Invalid opcode (non-8088 instructions) or out-of-range branch. T = Incorrect timestamp. Some viruses use this to mark infected files. J = Suspicious jump construct. Entry point via chained or indirect jumps. This is unusual for normal software but common for viruses. ? = Inconsistent exe-header. Might be a virus but can also be a bug. G = Garbage instructions. Contains code that seems to have no purpose other than encryption or avoiding recognition by virus scanners. U = Undocumented interrupt/DOS call. The program might be just tricky but can also be a virus using a non-standard way to detect itself. Z = EXE/COM determination. The program tries to check whether a file is a COM or EXE file. Viruses need to do this to infect a program. O = Found code that can be used to overwrite/move a program in memory. B = Back to entry point. Contains code to re-start the program after modifications at the entry-point are made. Very usual for viruses. K = Unusual stack. The program has a suspicious stack or an odd stack. Avoiding False Positives Just like all other generic detection techniques, heuristic scanners sometimes blame innocent programs for being contaminated by a virus. This is called a false positive or False Alarm. The reason for this is simple. Some programs happen to have several suspected abilities. If a heuristic scanner pops up with a message saying: This program is able to format a disk and it stays resident in memory, and the program is a resident disk format utility, is this really a false alarm? Actually, the scanner is right. A resident format utility obviously contains code to format a disk, and it contains code to stay resident in memory. The heuristic scanner is therefore completely right! You could name it a false suspicion, but not a false positive. The only problem here is that the scanner says that it might be a virus. If you think the scanner tells you it has found a virus, it turns out to be a false alarm. However, if you take this information as is, saying ok, the facts you reported are true for this program, I can verify this so it is not a virus, I wouldnt count it as a false alarm. The scanner just tells the truth. The main problem here is the person who has to make decisions with the information supplied by the scanner. If it is a novice user, it is a problem. Whether we call it a false positive or a false suspicion doesnt matter. We do not like the scanner to yell every time we scan. So we need to avoid this situation. How do we achieve this? Definition of (combinations of) suspicious abilities Recognition of common program codes Recognition of specific programs Assumption that the machine is initially not infected Performance of Heuristics Scanning Heuristics is a relatively new technique and still under development. It is however gaining importance rapidly. This is not surprising as heuristic scanners are able to detect over 90% of the viruses without using any predefined information like signatures or checksum values. The amount of false positives depends on the scanner, but a figure as low as 0.1% can be reached easily. A false positive test however is more difficult to perform so there are no independent results available. Pros and Cons A. Advantages Can detect future viruses. User is less dependent on product updates. B. Disadvantages False positives are possible. Judgment of the result requires some basic knowledge. Conclusions Thus, artificial intelligence technique helps improving the performance of antivirus softwares. This detection-avoiding method makes detection by conventional anti-virus products easier because it means that the programmer can not use very tight and straight code. The virus writer will be forced to write more complex viruses. Thus artificial intelligence increases the threat to virus writers. To answer this question I will firstly explain how EU law became incorporated within the member states I will then explain the various types of EU legislation's in circulation. This is important to define as the various types of methods will involve different enforcement procedures. Finally I will explain how EU law is enforced and the ways EU law will effect the member state and individual businesses. I will summarise my findings at the end of the essay, this will give details of all the key ideas I have ut across. The Schuman proposal began various European countries setting up the European Coal and Steal Community (ECSC), this was signed in 1951 by six countries. The countries that initially set up the ECSC were France, Germany, Italy, Luxembourg, Belgium and the Netherlands. The idea behind the ECSC was the first serious institutional committee in Europe and was the start of integration, the aim was to provide a common market of coal and steel trade. This meant that each of the states would be able to have access to the various qualities of coal and steel that the members had with no tariff of importing and exporting to the various countries. This let the countries concentrate on their more efficient areas leading to specialisation. The ECSC began the beginning of supranational power because the "High Authority could adopt binding decisions" (1) as elements of decision making were carried out by ECSC committees. A supranational power is where the member state has to abide by the de cisions made of the community, as they have power above the national level. When the EC makes a law it is up to the individual state to implement the legislation. An example of EU law which has been passed which has been adopted in the UK is that of the directive 75/117 which states that men and women should receive equal pay. The UK government adopted this directive with the 1975 Sex discrimination Act. There are a number of methods EU legislation is formed for instance regulations, directives and decisions are three different types of EU legislation. I am going to briefly explain these three as the way they will be enforced are different. Regulations have general application that means that all the member states have to adopt the regulation; the member state is expected to adopt the whole regulation. Regulations are directly applicable which means that the "individuals have rights that they can enforce in their own name through national courts"(2).

Tragic Character Flaws in The Strange Case of Dr. Jekyll and Mr. Hyde a
In the Strange Case of Dr. Jekyll and Mr. Hyde, the main character Dr. Henry Jekyll is a respectable doctor who experiments to separate his good and evil sides from each other. Dr. Jekyll eventually runs out of the contaminated potion and his evil side takes over. In The Monkeyââ¬â¢s Paw the White family takes possession of a monkeyââ¬â¢s paw that had a spell put on it granting three men three wishes. After not knowing what to wish for and the urging of his wife and son, Mr. White makes his wishes and realizes there are consequences for his choices. In The Demon Lover the character Mrs. Drover goes back to her old house in London to transfer items to her new home. She finds a mysterious letter and realizes she never knew her former fiancà © completely and is terrified for the day she would see his face. While she was on the way back to her current home, she gets abducted by a taxi driver who she recognizes as the soldier she said goodbye to twenty five years ago. In The Possib ility of Evil, the main character is an old lady who sends letters to clean her town of evil and eventually gets caught. The novel Dr. Jekyll and Mr. Hyde by Robert Louis Stevenson, the short stories The Monkeyââ¬â¢s Paw written by W.W. Jacobs, The Demon Lover by Elizabeth Bowen, and The possibility of Evil by Shirley Jackson all have characters who experience a downfall because of a tragic flaw. In the novel, The Strange Case of Dr. Jekyll and Mr. Hyde, the well-known and well liked doctor in London does not want to ruin his respected reputation with the satisfying wrongdoings of his other side. Dr. Jekyll wanted his two identities to be separated so that ââ¬Å"the just could walk steadfastly and securely on his upward path, doing the good things in which he found his pleas... ...use of her passion of keeping the world free of evil. In the world today there are many cases of people who do not get help when they might have PTSD until they have already hurt others. When any event causes the sufferer to remember the feelings associated with how they felt during the event that caused them to have post traumatic stress disorder, their rage could get hard to control if they do not get the help they need. In these characters and every human in real life, there is good and there is bad. Jekyll did not want to be caught being a criminal, the Whitesââ¬â¢ tried to be sensible about their wishes but still took a wish they did not need, Mrs. Drover feared and worried too much, and Miss Strangeworth did not mind her own business. We as humans judge others, worry too much about not so important things, do bad sometimes, but we can also choose to do good.

There is major concern about patient safety. It has been caused in part by obvious failures in which many patients have been harmed. This concern seems to be escalating worldwide. The medical culture that weââ¬â¢re in today seems to rely on secrecy, professional protection, defensiveness, and respect to authority. Theses ideologies are central to these failures, and preventing future failures depends on cultural as much as structural change in health care systems and organizations. Swiss Cheese Model James T. Reason developed the Swiss cheese model. The model is used in risk evaluations and risk management to determine accident causation. Itââ¬â¢s an accident causation model used in aviation, engineering and healthcare. It represents the human systems used and equates them to Swiss cheese slices put side by side. Sometimes it is referred to as the cumulative act effect. The structure of the Swiss cheese model applies to most risky fields, but I will discuss how it applies to healthcare. The developer theorized that most accidents could be traced back to more than one failure. These failures include organizational influence, supervision, preconditions and specific acts. Some examples of preconditions include fatigued workers, or communication errors. Unsafe supervision can be explained as putting inexperienced nurses in an Oncology unit to administer chemotherapy. Organizational influences can be perceived as performing understaffed when the consequences are known. An organizationââ¬â¢s guard against most failures, in the Swiss cheese model, are presented as a chain of walls, symbolized by the slices of cheese. The wholes that are in the cheese represent the weaknesses in individual parts of the healthcare system, and are constantly wavering i... ...ime or another, but if you can decrease that amount from what you normally see it could benefit your organizations reputation. The diversity of religions is another argument
Personally, I find the Hallsââ¬â¢ arguments convincing, maybe because they are consistent with my previous experience. My opinion is that science is a more reliable way of exploring the world. Its advantage is that there is only one science with the scientific method universally recognized in all or most parts of the globe, whereas the marginalization of different parts of society often occurs because there are different religions and people follow different views.The diversity of religions is another argument why science as a universal world outlook should take precedence before it.The scientific method seems to be a far more reliable method of exploring the world. It is based on observations, not some obscure revelations of prophets and messengers from God, and the scientist is expected to be thorough and honest in documenting the outcomes of the experiment. Of course, there is also room for the construction of hypotheses that come arbitrarily out of somebodyââ¬â¢s mind, but these have to be substantiated with factual evidence in order to become valid knowledge.Presupposition of the existence of some kind of transnatural forces will inevitably mar the investigation of scientific facts because it leaves too much space to issues that arbitrarily affect the results of the investigation. Some people can object to the scientific method because they think it will leave the world very dry and boring.People have to understand that this mystical view of the world can leave it unexplored because consideration of issuers irrelevant to the process will have to become part of it.2.
